Uh, first of all, it's a judge's job to apply the Constitution. And empathy is not antithetical to logic. Considering Obama is not opposed to same sex marriage, he would be most likely to appoint judges who feel the same way, therefore showing the utmost empathy for gays by extending equal rights.
